Introduction and Acceptance of Terms
Thank you for using Omnis, a Discord bot designed to enhance your chat experience with it's lively presence and advanced chat features powered by OpenAI. Before using the bot, please read and agree to the following terms of service agreement. By accessing and using Omnis, you agree to be bound by these terms.
These Terms and Conditions ("Terms") govern your use of the Omnis Discord bot, provided by Omnis's sole developer ("Developer"). Your access to and use of Omnis is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use Omnis.
By accessing or using Omnis, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using Omnis on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms, in which case the terms "you" or "your" shall refer to such entity.
Modification of Terms
The Developer reserves the right to modify, amend, or update these terms and/or the privacy policy at any time without prior notice. It is the responsibility of the users to regularly review the current terms and conditions before using Omnis. Continued use of Omnis after any such changes shall constitute your consent to such changes.

User Age Requirement
In compliance with Discord's terms of service, you must be at least 13 years old to use Omnis. Additionally, you must comply with the minimum age stipulations mandated by the laws of your residing country. If you are under the age of 18, you must have the permission of your parent or legal guardian to use Omnis. By using Omnis, you represent and warrant that you meet these age requirements and have obtained the necessary permissions if applicable.
If you’re a parent or legal guardian, and you allow your child (who must meet the minimum age for your country) to use Omnis, then these terms also apply to you and you’re responsible for your child’s activity with Omnis, including purchases made by them.
Premium Features and OpenAI Credits
Omnis offers premium features accessible through a monthly Patreon subscription starting at $5.00. User's access to OpenAI credits each month is determined by their pledged amount. When you submit an image or prompt generation request, it's usage cost is deducted from your allowance only if the request is successful. If users exceed their credit allowance, prompt and image generation will be temporarily disabled until the next billing cycle or until the pledge amount is increased. Credit usage is reset at the beginning of each billing cycle, and any remaining credits do not carry over to the next month. Users are encouraged to monitor their credit usage to avoid any disruptions in service.
When you subscribe to Omnis premium, you are buying an individual membership for yourself that cannot be shared with anyone else. Upon successful payment and linking your Patreon and Discord accounts, you'll recieve access to the benefits of a premium membership. These benefits include:
- OpenAI prompt and image generation.
- The ability to make Omnis speak in a voice channel using Google's Text-to-Speech.
- The ability to wake Omnis up in a voice channel by saying it's name.
- Changing the voice and/or summon greeting of Omnis for your account.
- Using volume commands with the audio player.
Privacy and Data Handling
The Developer prioritizes user privacy and does not collect any personal information for marketing or advertising purposes. Conversations are stored in memory temporarily and are cleared after two minutes of inactivity. These conversations are used in conjunction with OpenAI for generating responses. Once a conversation is cleared from memory, it can no longer be accessed by Omnis. Omnis does not log any message content or use it for training AI models. Please refer to OpenAI's privacy policy to learn how they handle message content sent to them through Omnis.
Omnis utilizes Google's Text-to-Speech (TTS) technology to provide its TTS functionalities and Google's Speech-to-Text (STT) technology for it's voice command features. Importantly, by default, Google does not log customer audio data or transcripts as seen in their Data logging doc, and Omnis also adheres to this practice, ensuring that your audio interactions remain private and secure. Omnis is not set to opt-in to Google's data logging program, and your voice data is not stored or logged by either Google or Omnis, allowing you to use these features with confidence in the protection of your privacy.
For users with a premium membership, user settings are stored and linked to a Discord User ID (also known as a Snowflake), which is a string of numbers unique to each user. This number is solely used for storing user settings and is not utilized for identifying, profiling, or monitoring users in any way. The developer is committed to ensuring the confidentiality and security of your information. Premium users also gain access to Porcupine Wake Word Detection from Picovoice to wake Omnis up in a voice channel by saying it's name. Picovoice's privacy policy states that no audio data is tracked, stored, or reviewed by Picovoice or any other third party to improve Picovoice Services or Software unless otherwise requested or specified.

Limitation of Liability and User Responsibility
Omnis is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. The Developer makes no warranties or representations about the accuracy or completeness of the bot's content or the content of any sites linked to Omnis and assumes no liability or responsibility for any but not limited to:
- Errors, mistakes, or inaccuracies of content;
- Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Omnis;
- Any interruption or cessation of transmission to or from Omnis;
- Any bugs, viruses, trojan horses, or the like which may be transmitted to or through Omnis by any third party;
- Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via Omnis.
Users expressly understand and agree that their use of Omnis is at their sole risk. Omnis's sole developer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if the sole developer of Omnis has been advised of the possibility of such damages), resulting from but not limited to:
- The use or the inability to use Omnis;
- The cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from Omnis;
- Unauthorized access to or alteration of your transmissions or data;
- Statements or conduct of any third party on Omnis;
- Any other matter relating to Omnis.
By using Omnis, users agree to indemnify, defend, and hold harmless the Developer from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit, or otherwise make available through Omnis, your use of Omnis, your connection to Omnis, your violation of the terms, or your violation of any rights of another.
Users accept all associated risks upon using Omnis and acknowledge that the Developer is not liable for any damages resulting from the bot's use. It is the user's responsibility to evaluate the accuracy, completeness, and usefulness of any information provided by Omnis.
Termination of Services
You have the right to terminate your access to Omnis at any time. If you wish to terminate your access, you may simply discontinue using Omnis and unsubscribe from the Patreon membership (if you were a premium user). If no violation of these Terms has occured, you may continue your use of Omnis at any time.
The Developer reserves the right to terminate or suspend your access to Omnis at any time, with or without notice, for conduct that the Developer believes violates these Terms or is harmful to other users of Omnis, the Developer, or third parties, or for any other reason at the Developer's sole discretion. Reasons for termination or suspension may include, but are not limited to:

Violations of Terms
- Breaching any provision of these Terms or any other policies or guidelines applicable to Omnis.

- Engaging in illegal activities or conduct that promotes illegal activities.

Abusive Behavior
- Harassing, threatening, or abusing other users or any third parties.

Security Concerns
- Compromising the security of Omnis or the integrity of the service.

Spamming and Disruption
- Spamming, flooding, or otherwise disrupting the normal flow of dialogue or interfering with Omnis.
Upon termination or suspension of your access to Omnis, your right to use Omnis will immediately cease. You acknowledge and agree that any termination of your access to or use of Omnis may be effected without prior notice, and that the Developer may immediately blacklist your account and delete all related information with it.
The Developer shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension of your access to Omnis or any other actions taken by the Developer in connection with such termination or suspension.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Handling of Premium Memberships
For users subscribed to premium features, Omnis performs periodic checks for declined or refunded payments. If a subscriber is found to have a declined or refunded payment, the following actions will be taken:
- Users with declined or refunded payments will lose access to premium features, including prompt generation, image generation, and Text-to-Speech features. However, these users will still have access to all other standard functionalities.
- Access to these features will be restored upon the successful resolution of payment issues, either by updating payment information or resolving any disputes.
Refund Policy
Eligibility for Refunds
Refunds for Omnis premium memberships are handled on a case-by-case basis. Users may be eligible for a refund under the following conditions:
- Accidental/Unauthorized Charges: If you were accidentally charged for a premium membership.
- Service Issues: If you experienced significant service disruptions or technical issues that could not be resolved in a timely manner.
- Other Reasons: Any other reasons deemed valid by the Developer.
Refund Request Process
To request a refund, users must contact the Developer within 30 days of the charge. Please include the following information in your request:
- The name on your Patreon account.
- Your Discord User ID (Snowflake).
- The date and amount of the charge.
- A detailed description of the reason for the refund request.

Non-Refundable Situations
Refunds will not be issued in the following situations:
- Past Months: No refunds will be issued for payments past 30 days, unless the payments are deemed unauthorized or a refund is required by law.
- Violation of Terms: Refunds will not be issued if your account is terminated due to violations of the Terms and Conditions, unless the payments are deemed unauthorized or a refund is required by law.
Changes to Services
The Developer reserves the right to modify, update, or discontinue any aspect of Omnis at any time, with or without notice. These changes may include, but are not limited to, updates to features, functionalities, and pricing of premium services.
Notification of Changes
While the Developer may not always provide advance notice of changes, efforts will be made to inform users about significant updates through appropriate channels, such as announcements on the Omnis Discord server, or updates on the official website.
User Responsibility
It is the user's responsibility to stay informed about any changes to Omnis. Continued use of Omnis following the implementation of changes constitutes your acceptance of those changes. If you do not agree with the modifications, you may discontinue using Omnis.
Service Updates
To enhance performance, security, and user experience, regular updates and improvements may be applied to Omnis. These updates may be automatically installed without prior notification, and may temporarily bring Omnis offline for a reboot.
Discontinuation of Features
Certain features or services may be discontinued if deemed necessary by the Developer. If a feature is critical to your use of Omnis, you are advised to check for any announcements regarding its status regularly.
Feedback and Suggestions
User feedback and suggestions are valued and can be submitted to the Developer. While there is no obligation to implement suggested changes, constructive input helps improve the service for all users.
By using Omnis, you acknowledge and accept that the Service is subject to change, and the Developer is not liable for any consequences arising from these changes.
Governing Law and Jurisdiction
These terms and any disputes related to these terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to it's conflict of law principles. Any disputes arising from or in connection with this agreement will be subject to the exclusive jurisdiction of the state and federal courts located in Cowley County, Kansas. By using Omnis, you agree to submit to the personal jurisdiction of these courts for the resolution of any such disputes.
Severability Clause
If any provision of these terms is deemed invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect. Such invalidity or unenforceability shall not affect the validity or enforceability of any other provision, which shall remain in effect and be enforced to the fullest extent permitted by law.
